According to the TSA

“Marijuana and certain cannabis-infused products, including some Cannabidiol (CBD) oil, remain illegal under federal law except for products that contain no more than 0.3 percent THC on a dry weight basis or that are approved by the FDA.”

So, the answer is yes!

Please keep in mind that the TSA does have restrictions on the volume of fluid products that can be carried on the plane with you. These are limited to 3.4 ounces (100 milliliters) per item, and they must be placed in a one-quart clear zip-top bag. No more than one bag of this type is allowed per traveler. If your product is larger than that, you should place it in a checked bag. It is always best to keep any products containing CBD in their original package to avoid any questions. While some researchers believe that the combination of THC and CBD work together to provide health benefits, others are concerned about their exposure to THC, particularly if they are taking the product internally.

The Legal Landscape of Hemp-derived Products

The Farm Bill

Since 1990, cannabis has been classified as a Schedule I drug that has been illegal to grow, distribute, and use in the United States. Recently there have been changes to these regulations, prompted by the passing of the 2018 Farm Bill.

This bill removed Cannabis sativa L. from the Controlled Substances Act list as long as it contained less than 0.3 percent of dry weight, and expanded the previous bill (Farm Bill 2014), which allowed state agriculture departments and institutions of higher education to grow cannabis under a research pilot program as long as state law permitted it.

Because of this, many different pilot programs were established across the country to study for a variety of uses, including medical purposes. The success of these programs gave the agricultural community the leverage it needed to push for change.

FDA public hearings

Recently the FDA held a public hearing to gain more scientific information about products containing cannabis or cannabis-derived compounds. At this hearing, over 100 speakers participated, and more than 1,000 people registered to join the discussion. The testimony was presented by representatives of academia, agriculture, public safety, and retail, as well as consumers, patients, and healthcare advocates and professionals.

Many of the speakers conveyed their personal opinion (or that of a group) on how the FDA should regulate this industry. Some of these speakers demanded strict oversight, while others lobbied for looser regulation. The FDA believes that the consumer needs to know that CBD products are safe to use, as well as the potential for side effects and drug interactions. Thus, they are working to streamline this endeavor.

Following the presentations by the various speakers, the FDA representatives asked specific questions about the production and use of CBD and encouraged all attendees to submit additional, detailed information (particularly data) through the official portal by July 2, 2019 — which has now been updated to July 16.

While the FDA is playing catch-up, the medical cannabis landscape is still a revolutionary achievement.
